Client Agreements
1. Client agrees to Modern Photography Group, LLC and its brands(PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel)’s policy and all terms and conditions therein by submitting payment for session. All transactions between the Photographer and the Client, whether made with payment or in writing, are subject to these terms and conditions. Contracts taken over the phone are executed with payment of deposit. Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) considers a session booked only upon receipt of payment. Session fees are for “time and talent” and do not include product of any kind. All monies paid to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) are NON-REFUNDABLE.
2. Venue: This contract shall be interpreted in accordance with the laws of the State of Florida without regard to any conflicts. All claims, disputes, and lawsuits arising out of or in connection with this Contract shall be resolved or adjudicated in the city of St. Petersburg, FL. Venue contact person info shall be provided upon request.
3. In the event that client wishes to reschedule a session, all amounts paid or owed are NON-REFUNDABLE. In the event of postponement, notice must be given in writing at least 2 weeks prior to the scheduled time and must be rescheduled within same calendar year one time only. If there is a scheduling conflict due to our inability to attend rescheduled event 75% of all moneys owed or paid will be forfeited to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel). If a client cancels later than 2 weeks and we are able to sell the spot without a discount, Client will be welcome to reschedule without penalty however if we can only sell the spot by offering a discount, a $100 reschedule fee will be taken from monies paid and Client moved to next event or all monies paid will be forfeit by Client. If a Client does not show up to her session or cancels within 48 hours of an event, session fee will be forfeit/ owed and customer will be liable for payment.
4. Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) takes utmost care to honor scheduled session times and to deliver products and services as promised. However, should Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) or agents be unable to perform services due to severe illness, injury, family crisis, or unforeseen emergency, to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) reserves the right to reschedule the session within calendar year or delay product design until time in which design can be properly performed or offer a 50% returned for session fees paid.
5. Client understands that our session fee includes unlimited access to images online, secured online gallery and discount printing options for seven months. All images are subject to be purged 15 months after their final upload unless noted in contract.
6. Images may not be reproduced or altered for any reason without prior written authorization. Commercial use of images is strictly prohibited. Purchased digital images by client may be used by client for personal website, personal professional websites, social networking sites, or shared to other private parties. Digital images may not be sold to any other party. Images may not be entered into any contest or submission without prior written authorization. Online images will be locked. Screen grab downloads, printing of digital images and scanning of prints for digital imagery use is illegal and punishable by law. Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) reserves the right to display, publish, exhibit, alter, sell, and disseminate images in any way and retains full artistic credit for all work.
7. Any breakage or damage to equipment, studio contents, or hotel belongings by client are the sole financial responsibility of client/ customer. Client agrees to hold to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) and its owners/agents harmless for any injuries, damages or legal liability preceding, during, and following a session. In the event the Client’s behavior becomes abusive to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel), any member of their team or other clients, Client will be asked to leave, session canceled and all payments forfeited.

9. Editing of Photographs (Photoshop, Lightroom, and post production): All event photographs are subject to no editing. No editing will be applied to photographs that are captured for an event. At times there is a need for slight color correction or sharpening. It will be at Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel)’s discretion to apply necessary corrections. No editing for photo booth products or any product where printing is on-site. All other photographs will be subject to light editing and color correction. All editing for base price and discounted photo sessions will be applied to color balance and above the neck adjustments. Large blemishes or heavy acne will not be removed completely only minimally corrected. Please see examples for our style finished images. Major correction processes can be purchased for non-refundable $100 per hour, two hour minimum.
10. All employees of Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel) will be allowed a 15 minute uninterrupted break every two hours. As a courtesy, you the client will allow any employee to partake in non-alcoholic beverages and refreshments provided at this time.
11. At all events, as noted by contract, two 6’ tables, three chairs and safe area will be provided to our company at no cost to Modern Photography Group, LLC and its brands (PromPhotography.com, Firefly Event Photography, Pierce Brunson Photography and Modern Tassel).
